TRIAL PRACTICE
Many people question what a trial attorney is, and whether they actually need one. A trial attorney is an attorney who is involved in trials to resolution of cases. It involves having the knowledge and skill to take a case to trial before a jury or judge. Contrary to popular opinion, it does not mean that the attorney does nothing but appear in court. Trial attorneys prepare your case as any other attorney would, however, always with the caveat, this action may go to trial, therefore, all preparation must be done within compliance with court procedural rules and the rules of evidence. Preparation of a case that has evidence that does not comply, and cannot be admitted to court as evidence, does not help the client.
Q. What cases go to trial?
A. Any case that cannot, or does not resolve through alternative resolution means, will go to trial for final resolution. This includes, criminal, civil, family law, worker compensation, and probate matters, among others.
Q. Does a trial attorney only prepare to go to trial?
A. No, as with all attorneys, the best interest of the client is the premier concern, if the case is such that it does not need to be in trial to reach a conclusion that is in the best interest of the client, then he, as non-trial attorneys, seeks resolution.
Q. Do I need a trial attorney?
A. It cannot be said by any attorney that you need a trial attorney from the start of your case. No one can predict exactly how your case will proceed. In retaining a trial attorney from the start of your action, you have the knowledge and security that you will have someone who has the knowledge and experience to take your case through final resolution, even if it means trial of the action.
Q. What is the benefit of retaining a trial attorney?
A. As previously stated, a trial attorney prepares all cases with the perspective of trial if necessary. He is ready, through preparation and experience, to go to trial if it becomes necessary. In retaining an attorney who is not experienced with trial of cases, it may be necessary for him to associate or retain a trial attorney for you, to handle the trial of the action. This may delay your case and may add additional expense to you.
